When can an LPA be used?

If I register an LPA does it become effective straight away? If now what extra procedure is required?

Answer: The LPA registration process typically takes at least 3 months.

For a Property and Affairs LPA, it will (only) then be immediately usable, if that is what it says (not all do) AND with the agreement of the donor to that and to the decisions.   Authority remains with the donor, not the attorney, so long as the donor is able to make their views known with aids if necessary.

The Health and Welfare LPA cannot be used at all unless the donor has lost mental capacity, and you are still required to make every effort to establishing the donors views.
